Privacy Policy

1. GENERAL

1.1 This privacy policy sets out how we will store and use information relating to you when you purchase products from us, contact us or our customer service or sign up for or take part in an event that we arrange (together the “Services”).

1.2 Desktop Ideas Ltd, (the “Company”, “we” or “us”) is the controller of personal data.

 

2. COLLECTION OF PERSONAL DATA

2.1 We collect personal data to provide our Services in the best possible manner. When you use the Services, we collect and store the following information that you provide: company name, customer number, name, address, email address and phone number.

2.2 If you contact us or our customer service in relation to your order, we may – in addition to what is set out above – store such information you provide to us or our customer service. It may e.g. be in relation to inquiries regarding our business operations or products, or if you send us your CV or apply for a job.

2.3 If you take part in an event that we arrange, we may take pictures that we use for marketing purposes and which we publish in various internal and external channels.

2.4 Please note that information that may identify you as an individual is considered personal data, even if you place the order on behalf of a company.

 

3. OUR USE OF YOUR PERSONAL DATA

3.1 We use the personal data we collect for the following purposes:

a) To accept and process your order.

b) To, when needed, contact you in relation to your order or to get back to you if you have contacted us.

c)To deliver and invoice the goods you have ordered (including to notify you of delivery).

d)To manage complaints and warranty related matters, legal matters and questions to our customer service.

e) To administer and improve the Services.

f) To provide such services you have requested (e.g. to receive our newsletter).

g) Provided that you have not opted out, to send you information regarding us, our products and our services – if you have provided your address or email address in connection with an order, or discussion regarding an order, of a product or service.

h) To market us, our products and services.

i) To manage our IT systems or if it follows from law or a decision by a public authority.

3.2 The Company does not collect or purchase customer data from a third party. Neither do we disclose your personal data to a third party, except and insofar it is necessary to fulfil the purposes set out in section.

3.3 Partners who process personal data on our behalf will always enter into a data processing agreement with us, to ensure that our partners maintain a high level of security for your personal data.

 

4. LEGAL GROUND FOR PROCESSING OF PERSONAL DATA ETC.

4.1 Personal data may only be processed if there is legal ground, and the Company will always process your personal data in accordance with applicable law.

4.2 In connection with purchases, the Company will process personal data since it is necessary for us to fulfil the purchase agreement with you. Certain processing is based on a balancing of interest, i.e. that it has been assessed that we have a legitimate interest to process the data for a certain purpose and the processing is assessed not to infringe your integrity. This is e.g. the case when we send marketing to customers, which is based on our legitimate interest to provide relevant information and offers to our customers. The assessment is primarily based on that the data we process is harmless and that the extent of the processing is limited. In case we need to process personal data for legal matters (e.g. in relation to product liability), it is a legitimate interest for the company to protect our legal interests.

5. HOW LONG DO WE KEEP DATA?

5.1 We will only keep your personal information for as long it is necessary according to the purposes set out in section 3.1 or is mandated by law.

 

6. HOW WE PROTECT YOUR PERSONAL DATA

6.1 The Company has taken necessary and appropriate technical and organizational measures to protect your personal data from unauthorized access, disclosure, loss, or use of personal data. For example, our systems have restricted access, and the data is protected behind firewalls and through encryption.

6.2 If your data is processed by us or a partner outside the EU/EEA, we will take additional security measures, such as entering into an agreement containing the Standard Contractual Clauses for Data Processors established in third countries which have been adopted by the European Commission.

 

7. LINKS

7.1 Please note that the Website may contain links to other websites which are outside the control of the Company. These links may be provided to help you find information we believe are of interest to you as a customer. The Company is not responsible for the protection of your integrity or the contents on such websites, and we ask you to observe that such websites have their own terms and conditions and to review how they process your personal data.

 

8. SPECIFIC TERMS AND CONDITIONS

Our standard terms and conditions of sale apply to all transactions unless otherwise agreed in writing. All figures in these terms are subject to VAT where applicable under law.

8.1 Please note that certain services and products (included but not limited to the Services) provided by us may be governed by specific terms and conditions including a specific privacy policy. In the event of any conflict or inconsistency between this Privacy Policy and the specific terms and conditions, the specific terms and conditions shall prevail.

 

9. YOUR RIGHTS

9.1 You have the right to, in accordance with applicable data protection legislation, at any time request access to the personal data concerning you that we process. Further, you have the right to obtain rectification of inaccurate personal data concerning you, to obtain erasure or restriction of processing of personal data concerning you, to exercise your right to data portability and to object the processing of personal data concerning you.

10. ORDER TERMS & CONDITIONS OF SALE INCLUDING RETURNS POLICY.

10.1 All sales are made on a trade basis and subject to our terms & conditions. Sales will be on a Proforma basis for non-Customer Account holders.

10.1.1 Customers can apply for a Customer Account where an application for Credit Terms can also be made at the same time. Requests for Credit Terms may not be accepted whereby Proforma terms will apply to all sales.

10.2 Deliveries should be checked carefully before being signed for, to ensure the number of packages you have signed for have been delivered. We cannot take responsibility for non-delivered packages if they have been signed for.

10.3 Size specifications, colour and quality should be checked before decoration. No credit can be given for worn, decorated or processed garments.

10.4 All orders for products supplied will be charged in accordance with our correct price list unless otherwise agreed with a company employee at point of sale.

10.5 Claims arising from shortages or damaged goods must be made within 5 working days of receipt.

10.6 Claims for non-delivery must be made within 7 working days of dispatch.

10.7 Desktop Ideas Ltd makes reservation against any faults that may occur in the price list or our catalogues and for possible price changes during the year.

 

11. GARMENT RETURNS

11.1 Please remember to check all sizing & quantities before print and/or embroidery, as no credit will be allowed for worn, decorated or processed garments.

11.2 All sales are final.

11.3 The company does not trade on a Sale or Return basis.

11.4 Returns may be accepted subject to the following:

11.4.1 If goods have been sent incorrectly, please ring our Customer service team within five working days to arrange a collection and re-ship.

11.4.2 Faulty goods must be returned within seven working days of supply with the fault clearly indicated and without defacing the garment.

11.4.3 Returns will only be accepted by prior arrangement. You should ring or email the customer service team (sales@desktopideas.com) with a List of the goods to be returned (please have this information ready). You will also need to complete our returns note and you must supply order number and list all items. Please clearly mark the outer package with your company name and insert the returns note in each box listing the garments inside.

11.4.4 Samples are returnable and must be returned within 30 days in all original packaging.

11.4.5 Please note, with exception of faulty goods and miss ships, Desktop Ideas Ltd will use its discretion whether to accept goods for return. In any event, no goods will be accepted for return later than one month after supply.

11.4.6 A minimum of 15% handling and administration fee will be applied to all goods returned, unless faulty.

11.4.7 All garments must be returned in original, undamaged packaging - failure to do so will result in the goods being refused.

11.4.8 Under no circumstances whatsoever will soiled/used goods be accepted; these will be returned to you immediately at your cost.

 

12. DELIVERY & CARRIAGE INFORMATION

Online Ordering UK / Northen Ireland.

• Free freight when order meets £150.00 (excluding vat) orders below will be charged at £8.50 / NI £15.00

Email or Phone ordering.

• Free freight when order meets £250.00 (excluding vat) orders below will be charged at £8.50 / NI £15.00

• Republic of Ireland deliveries will be charged at €19.00 if the order is below €250.00 and must be placed by phone or email, if the order is above €250.00 freight will be free of change.

• Pre 10.30am delivery to the UK £18.50 to 1 UK address

• Pre 12.30am delivery to the UK £12.50 to 1 UK address

• Express from Europe to the UK is charged at £40.00 per box.

If goods are held by customs Desktop Ideas cannot be held responsible for the delay, no refund will be available on express charges.

Special delivery upon request and subject to availability. This will be chargeable. Every endeavour will be made to dispatch orders received before 3 PM

 

13. PAYMENT TERMS & PRICES

13.1 All orders for our products will be subject to our current price list unless otherwise agreed at the point of sale whether that is online, by email or telephone.

13.2 Pro forma payment may be required for Non-Customer Accounts and Customer Account holders.

13.3 Customer Account terms of payment will apply subject to satisfactory credit references. The references requested maybe from a Credit Reference Agency or Trade Partners as listed on the Account Application Form.

13.4 Full payment is required Strictly 30 days from date of invoice. Some Customer Accounts may have varying terms by agreement. Failure to pay any invoice to the terms of the invoice may, without notice, place a Customer Account on Hold. Accounts on Hold will have all existing outstanding / newly presented Orders not distributed until payment has been made in full for overdue amounts.

13.5 All prices are subject to alteration at any time without notice.

13.6 Returned or represented cheques will be charged a £25 per representation.

13.7 The goods remain the property of Desktop Ideas Ltd until they have been paid for in full by the customer.

13.8 We reserve the right to charge interest on all overdue accounts. the rate of interest chargeable will be to Bank of England base rate plus 2.5%
